Most of them are simple if they are dealt with on time and expensive if they come to light during an inspection. At Tecem Abogados we have put together the list of what you need to have sorted before day one, with the regulation behind each point.

The company registers with Social Security before hiring

If you have never had employees, the first step is not the contract but the company. The General Social Security Act (Ley General de la Seguridad Social) requires employers to apply for registration in the General Scheme “as a prior and essential requirement” when they start their activity. With that registration you obtain the contribution account code, the number Social Security uses to identify your company as an employer.

In the application you will have to state, among other details, the managing body or the collaborating mutua that will cover occupational contingencies, and the applicable collective agreement. If you are self-employed and about to hire your first employee, the obligation is the same: for these purposes you are an employer too. If you are also thinking of making the jump to a limited company, you may be interested in what we explain about moving from self-employed to an SL.

Your first employee’s registration is filed before they start, not after

This is the most common mistake and one of the most closely monitored. The Social Security regulation on affiliation and registrations states that the registration application must be submitted “prior to the start of the provision of services”. It makes no difference whether it is a trial day or a first shift to get to know the job: if your first employee starts working without being registered, you are already out of time.

If the company fails to comply, the worker can request their own registration directly, and the General Treasury of Social Security reports that request to the Labour Inspectorate.

The contract, in writing and notified within the following 10 days

The Workers’ Statute (Estatuto de los Trabajadores) allows verbal contracts, but requires written form in many cases: part-time contracts, permanent seasonal (fijo-discontinuo) contracts, training contracts, temporary contracts of more than 4 weeks or remote work contracts, among others. In addition, either party can ask for it to be formalised in writing at any time. Our advice is clear: always sign your first employee’s contract in writing.

Once it is signed, you have to notify its content to the public employment office within the 10 days following its conclusion, whether or not the contract had to be in writing. The same applies to any extensions. On top of that come two duties that often go unnoticed:

Basic copy of the contract. If the contract must be in writing, a basic copy is drawn up and sent to the employment office, even if the company has no workers’ representatives.

Written information. If the relationship lasts more than 4 weeks, you must inform the worker in writing of the essential elements of the contract that are not already included in the signed document.

The collective agreement sets your first employee’s conditions

Before drafting the contract, find the collective agreement that applies to your activity and your area. It sets a good part of the minimum conditions: salary, working hours, holidays and probationary period, as well as job categories, bonuses and leave. The contract cannot set conditions less favourable than those in the agreement: if it does, that part is void and is filled in with what the regulation says.

Pay particular attention to the probationary period. It must be agreed in writing and respect the limits in the agreement. And if your first employee had already performed those same duties in your company before, the agreement is void.

Occupational risk prevention starts with the first contract

The Occupational Risk Prevention Act (Ley de Prevención de Riesgos Laborales) does not wait for your workforce to grow. From your first employee onwards you have to organise prevention in your company, and that comes down to three obligations:

Risk assessment of the job, taking into account the activity, the characteristics of the job and of the person who will hold it.

Information for the worker about the risks of their job and the protection and prevention measures in place.

Theoretical and practical training at the time of hiring, whatever the type or duration of the contract, within working hours whenever possible and at no cost to the worker.

To comply you can use an external prevention service or, in certain cases, take on those duties yourself. What matters is that your first employee’s assessment, information and training are done and documented.

Your first employee’s working-time record is kept from day 1

Daily recording of working hours has been mandatory for all companies since 2019, including those with a single worker. The Workers’ Statute requires it to include the specific start and finish times of each person’s working day. It is organised through a collective agreement, a company agreement or, failing that, a decision by the employer after consulting the workers’ representatives, if there are any.

A simple, reliable system from the outset saves you trouble: the record must be available to your first employee and to the Labour and Social Security Inspectorate.

The anti-harassment protocol is mandatory whatever the size of your workforce

This is the point that surprises first-time employers most. Organic Law 10/2022 (Ley Orgánica 10/2022) requires companies to promote working conditions that prevent conduct against sexual freedom and moral integrity, with special attention to sexual harassment and gender-based harassment, including in the digital sphere. It adds that they must set up specific procedures to prevent such conduct and to channel complaints from those who suffer it.

The law does not set a minimum number of workers: the obligation exists from the moment you hire your first employee. In practice, that means having a written protocol, making it known and knowing how to act if a complaint comes in.

What it costs to sort things out late

None of the steps for hiring your first employee is complicated on its own. The problem arises when they are done late, half-done or without the paperwork to prove them, and it almost always comes to light at the worst moment: an inspection, a claim or a sick leave. Going through the list calmly before your first employee walks through the door is much cheaper than correcting it afterwards.

At Tecem we support companies and self-employed professionals in Málaga and on the Costa del Sol with each of these procedures, from Social Security registration to the harassment protocol. If you are about to hire your first employee, tell us about your case and we will have everything in order before day one.

Prepare your first hire →
How to get to the office →

Frequently asked questions

How far in advance can I register my first employee?

The registration must be submitted before they start working, but never earlier than 60 calendar days before the planned start date.

What happens if a contract that had to be in writing is made verbally?

The Workers’ Statute presumes it is permanent and full-time, unless it is proven that it was temporary or part-time. One more reason to put everything in writing from the start.

Can I handle risk prevention myself?

Yes. From your first employee up to 10 workers you can take it on, provided you carry out your activity regularly at the workplace and have the necessary capacity for the risks involved. The option extends up to 25 workers when the company has a single workplace.

How long can the probationary period last if the collective agreement says nothing?

Up to 6 months if your first employee is a qualified technician and 2 months in all other cases. In companies with fewer than 25 workers, the limit for those who are not qualified technicians rises to 3 months.

How long do I have to keep the working-time record?

4 years. During that time it must be available to the workers, their representatives and the Labour and Social Security Inspectorate.

Social Security registration, prior enrolment, contract notified within 10 days, collective agreement, risk prevention, working-time record and harassment protocol: what you need before hiring.

About to hire your first employee?
